1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Jack's Plumbing ("we," "our," or "us") governing your access to and use of our website, services, and mobile applications (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

2. Services

Jack's Plumbing provides plumbing services for residential and commercial properties, including but not limited to leak detection and repair, plumbing installation, water heater services, bathroom remodeling, drain cleaning, and sewer line services.

We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time, with or without notice. We will not be liable to you or to any third party for any modification, suspension, or discontinuance of the Services.

3. Service Appointments and Cancellations

3.1 Scheduling

When scheduling a service appointment, you agree to provide accurate and complete information. We will make reasonable efforts to arrive at the scheduled time, but exact arrival times cannot be guaranteed due to the nature of plumbing services and potential emergencies.

3.2 Cancellations

If you need to cancel or reschedule an appointment, please notify us at least 24 hours in advance. For cancellations with less than 24 hours' notice, we reserve the right to charge a cancellation fee of up to $75.

3.3 No-Shows

If you are not present at the scheduled service location at the agreed-upon time and have not notified us in advance, we reserve the right to charge a no-show fee of up to $100.

4. Pricing and Payment

4.1 Estimates

Any estimates provided for services are approximations based on the information available at the time. The final cost may vary based on the actual work required, which may not be fully apparent until work has begun.

4.2 Payment Terms

Payment is due upon completion of services unless otherwise agreed upon in writing. We accept cash, checks, and major credit cards. For larger projects, we may require a deposit before work begins.

4.3 Late Payments

Invoices not paid within 30 days of the service date may be subject to a late fee of 1.5% per month or the maximum rate permitted by law, whichever is less.

5. Warranties and Guarantees

5.1 Workmanship Guarantee

We guarantee our workmanship for a period of one year from the date of service. If a problem occurs due to our workmanship within this period, we will repair it at no additional cost to you.

5.2 Manufacturer Warranties

Products and parts installed by us are covered by the manufacturer's warranty. We will provide you with information about these warranties at the time of service.

5.3 Limitations

Our guarantees and warranties do not cover damage caused by abuse, misuse, neglect, accidents, or attempts to repair by unauthorized persons. They also do not cover issues arising from normal wear and tear.

6. Customer Responsibilities

As a customer, you are responsible for:

  • Providing accurate information about the plumbing issue
  • Ensuring reasonable access to the service area
  • Securing pets and removing valuables from the work area
  • Informing us of any known issues or hazards at the service location
  • Making decisions about recommended repairs or replacements

7. Limitation of Liability

To the maximum extent permitted by law, Jack's Plumbing shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Services
  • Any conduct or content of any third party on the Services
  • Any content obtained from the Services
  • Unauthorized access, use, or alteration of your transmissions or content

Our total liability for any claims arising under these Terms shall not exceed the amount you paid to us for the applicable service.

8. Indemnification

You agree to defend, indemnify, and hold harmless Jack's Plumbing and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:

  • Your use of and access to the Services
  • Your violation of any term of these Terms
  • Your violation of any third-party right, including without limitation any copyright, property, or privacy right
  • Any claim that your actions caused damage to a third party

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the state where our principal place of business is located, without regard to its conflict of law provisions.

10. Dispute Resolution

Any dispute arising from or relating to these Terms or the Services shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved through negotiation, it shall be submitted to mediation before resorting to arbitration or litigation.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any material changes by posting the updated Terms on our website. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
